KRAFT FOOD COMPANY Chapter I INTRODUCTION A. COMPANY’S HISTORY According to Frank (2010), in 1903, there was a man named James Lewis Kraft who had begun cheese delivery service at Chicago area after he had been eased out from a cheese company at Buffalo. Every morning, he will buy cheese wholesale and resold it to the local vendors in order to avoid the cheese melt or spoil. The business was successful and several of his brothers who are known as Charles H. , John H. , Fred Walker and Norman had joined the company named J. L Kraft & Bros. Co. in 1909 as permanent employees (MAC 2011).James L. Kraft is a president of the company who had invented a revolutionary process in 1915. This process helps to pasteurize the cheese, thus it would not spoiled easily and can be transported long distances (NNDB 2009). Fundamentally, according to Phillip (2010), in 1920, Kraft purchased a Canadian cheese company and changed it to Kraft Cheese Company in 1924. Kraft Cheese Company had obtained a lot of sales which enable J. L Kraft to expand the company into Germany, Australia and Britain. During World War II, Kraft had supplied 4 million pounds of cheese to Britain.It had showed that Kraft was a main food supplier at that time. In 1945, the Kraft Cheese Company became Kraft Food Company (NNDB 2009). B. COMPANY’S DESCRIPTION Kraft Food Company’s headquarter had been located at Cheltenham, United Kingdom since Kraft has a close connection with the rest of Europe. The manufacturing site had been established at the Ban bury as a global manufacturing base that will supply a variety type of products worldwide in 155 countries including Malaysia, China and United State (Kraft Food Inc. 2010). Kraft Food Company was having more than 100,000 diverse employees all over the world.Currently, Kraft Food Company is a second largest food and beverage company in the world after Nestle. C. TYPE OF PRODUCTS Furthermore, according to Joel (2010), Kraft Food Company is popula r with cheese and dairy, snack foods and confectionary, beverage and convenient foods. However, Kraft Food Company is basically focusing more on cheese and dairy products such as cottage cheese and sour cream. Kraft produces a wide variety of natural cheese and American cheese slices. Besides that, Kraft also been known as snack food brands especially cookies and crackers.Some of popular snacks food offers by Kraft are Kraft cheese Nips, Wheat Thins crackers, Corn Nuts and Garden Harvest toasted chips (Kraft Food 2011). Instead of that, sweet and confectionary food brands produced by Kraft are Oreo cookies, Kraft Mayo with olive oil, Jet-Puffed Marshmallows and Kraft salad dressings whereas for beverage and convenient foods are Kraft Macaroni and Cheese, California Pizza Kitchen and DiGiorno frozen pizzas, Yuban Coffee and Maxwell House (David 2009). PESTLE Analysis The PESTLE analysis contains the analysis of Political, Economic, Social, Technological, Legal and Environmental environments of a country with reference to a  particular object. The PESTLE analysis of Kraft Foods Inc. is as follows: POLITICALThey support candidates who understand and appreciate the public policies that impact their  business, brands and employees. The company has started a political action committee called Kraftpac or Kraft Political Action Committee which makes  funding to state political parties, committees and candidates. ECONOMIC Kraft is making good earnings from its market involvements via  its products and brands. The company is delivering high quality earnings to  its shareholders despite the difficult economic environment. In 2008, Kraft Foods was once again named to the Dow Jones Sust ainability World Index and the Dow Jones Sustainability North America Index in recognition of the  company’s economic, environmental and social performance. SOCIAL The company took  initiative to improve the  living standards of more than 1 million farmers with effective partnerships with them.They  increased their cocoa and coffee purchase to further benefit their partner farmers. Kraft Foods reduced greenhouse gas emissions by 18% and water consumption by 30% since2005, as measured against total production. Furthermore, the  company improved the nutritional profile of more than 5,500  products during the last five years. They removed nearly 6. 5 million pounds (3  million kg) of salt from products in 2010 and helped to provide more than 1 billion servings of food since 1999 in the United States alone. TECHNOLOGICAL The company keeps consumer needs in  their minds  before designing their strategies.They adapt  and anticipate their needs in order to  mee t them efficiently. The company has employed SAP Net weaver technology platform to ensure effective information and business transformation strategy within all the business units (FBR, 2008). Kraft foods have established a hub and spoke model where a centrally led team focuses on the overall strategies, systems, enabling tools, networks and metrics. And, they have complemented that central team with R&D people the open innovation â€Å"technical scouts†? embedded in each  of Kraft's business units. LEGALThe company abides by the laws, rules, and regulations of the national as well as  international countries in order to sustain its  profitability and its business operations. Almost all of the activities of the company’s food operations outside of the United States are subject to local and national regulations similar to those applicable to Kraft Philippines  businesses and, in some cases,  international regulatory provisions, such as those of the European Uni on relating to labeling, packaging, food  content, pricing, marketing and advertising and related areas.ENVIRONMENTAL Kraft Foods has set an example  in the global industry by determining a push  to reduce the impact of its operations on the environment in the U. S. and  around the world. The company released  its CSR report in 2010 which stated its environmental goals agenda to reduce the effects of energy and the carbon dioxide emissions in food plants to the conservation of water and minimizing excess packaging. They are creating packaging that uses less material, weighs less and reduces impact  on landfills without compromising food safety or freshness.As part of their plan to  reduce our â€Å"carbon footprint,† Kraft foods are improving their energy efficiencies, using  less energy and finding new and cleaner sources of energy. Kraft Foods look for opportunities to reduce the use of water to  minimize the  impact of water discharge and even reuse wat er  in ways that help the environment and save money. Lastly they are not only focusing on creating less waste in the manufacturing process, they are also finding new and better  ways to reuse, treat and even put waste to work. 3. Porter’s Five Forces AnalysisBARGAINING POWER OF SUPPLIERS The food and beverage industry is quite high and competitive in nature. The  prices offered are usually competitive to  remain in the market. THE BARGAINING POWER OF BUYERS The buyers preferences changes with the passage of time and they are likely to switch to the seller who offers good  quality at  less price. Wal-Mart has played a  major  role in this case. It offers less priced goods to  attract the buyers ¶ attention. There is a significant opportunity for the buyers to  extract industry and firm profits. THE THREAT OF THE ENTRY OF NEW COMPETITORSThere are already so  many competitors present in the market that there are very less chances for the new comers to se t foot in and enjoy their share in the market. The existing companies have already spent  so much on their brands, quality and positioning that it will be difficult for the new comers to entice switching among consumers. RIVALRY AMONG ESTABLISHED COMPETITIONS Intense competition lies in the food and beverage industry. The main vehicle by which firms in the industry preserve market share  is through brand loyalty and diversification.In general, the products of these  firms are highly elastic with consumers weighing the tradeoff between price and quality between companies and products. Consumers in the industry have minimal switching costs and there is never the guarantee of brand loyalty. Therefore, the way these firms maintain market share is by providing  brand quality at an affordable price. Thus, there is some cooperation among  firms against the erosion of market share to  private label products. With all firms promoting brand quality, there are signals passed onto t he consumer that brand name products are superior  to private label products in quality and elegance.There have been restructurings and realignments at Kraft and at other companies in the industry in order to increase volume and profitability despite increasing input costs, sluggish top  line growth, margin contraction, and rising pension costs. Compare and Contrast The Theology Of Judaism And Christianity

By   theology   we   mean   a   rational   and   systematic   study   of   a   religion. It   is   an analysis   to   understand   a   religious   matter. This   analysis   helps   us   to   understand   more   truly   our   religion, and   also   in   the propagation   of   our   religion. As   we   know, Judaism   is   the   religion   of   Jewish   people. Judaism   theology follow   monotheism   i.e.   belief   in one   single   God. Moreover   Judaism   theology   says that   God   knows   every   thing, has   unlimited   power, has created   the   universe   and   is kind   to   everyone. The   essence   of   believes   of   Jewish   people is   the   written and   oral Torah. Torah   is   a   Hebrew   word   meaning   teaching, instruction   or   law. It   is   basically a   set   of   five books   of   Moses   also   known   as   five   laws   of   Moses. Moses   is the Father   and   chief   of   all   prophets. Torah   says   that   all   living   and   non   living   things   in   this   world   are   creation of   God. It   is   the   God, who   has wrought   things, workout   and   shall   work   for   ever. It says   that   creator   is   one   and   is   incorporeal   i.e.   having no   corporeal   qualities   or   in other   words   He   has   no   material   or   physical   form   of   substance. It   says   that creator was   the   first   and   will   be   the   last, and   is   the   only one   to   be   worshipped   and   none else. Torah   also says   that   all   words   of   prophets   are   true. It   says   that   all   our   deeds and our   thoughts   are   known   by   God. As   there   is   a   saying   in   Judaism, â€Å"He   who   had   formed   their   hearts altogether, He   knows   all   their   deeds†. According   to   Torah God   rewards   those   who   keep   His   commandments   and   punishes those   who   go beyond   the   limits   of   what   is   morally   acceptable. One   of   the   most   ardent   faiths   of Jewish   people   is   that   there   will   be   a   resurrection   or   rebirth   of   God, but   on   the time   decided   by   Him. It   is   believed   that   every   man   and   woman   on   earth   is   like God, with   a   spiritual   and   always   existing soul. Everyone   is   made   to   be   the I mage and   likeness   of   God. For   most   Jewish   people, earth   is the   place   where   they   are   supposed   to   enjoy   their   life, not   in   the   heaven. According   to   them, hard   work   and   education   are the   paths   directed   by   God   to   live   a   good   life. They   do   not   find   accumulation   of wealth   to   be   an   evil   act   as   long   as   it is   used   in   good   deeds   and   charity. One   can live   a   comfortable   and   cozy   life   following   moral   rules. They   also   promote   honest sex   and   marital   life, but   oppose   adultery, premarital   sex, homosexuality, abortion   and   these as   sins. They   say   that   pleasures   life   like   drinking   and   dancing   are   good   if   not   Ã‚  done   in   excess. One   should   not   be   habitat   of   such   things. Judaism   theology   says   that   after   death   a   person   is   sent   to   heaven   or   hell. Heaven   is   considered   to   be   dwelling   of   God   and   angels. And   hell   as   home   of devils   and   place   where   wicked   people   are   punished. Now,   if   we   Ã‚  talk   about   Christian   theology, then   there   is   a   very   clear   doctrine or   set   of   believes   related   to   the   Holy   Trinity. It   says   that   there   is   only   one   God, with   three   persons, the   Father, the   Son   and   the   Holy   Spirit. Each   person   is   fully God, but   there   are   not   three   Gods   but   only   one   God. Christians   consider   God   himself   Ã‚  as   a   community   of   love. The   father   loves   Son, and   the   Son   loves   the Father   and   this love   of   the   Father   to   the   Son   and   of   the   Son   to   the   Father   is   the Holy   Spirit. Three   persons   but   only   one   true   God. This   is   the   most   glorious   mystery   of   the   Holy   Trinity   in   the   whole   Bible. It   is   said   that   God   is   repeatedly the   God   of   Abraham, the   God   of   Issac   and   the   God   of   Jacob, symbolizing   the   Holy   Trinity. Abraham   is   God   the   father, Issac   is   God   the   Son   and   Jacob   is   God the   Holy   Spirit. In   Christianity   faith   is   the   basis   of   a   Christian’s   life, the   foundation   of   the Christian building. One   of   the   faiths   is   that   the   person, who   believes   in   the   Son, has   eternal   life, whoever   disobeys   Him   will   not   see   life, but   God’s   wrath   resets upon   him. Christians   take   baptism   a   way   by   which   the   original   sin is   forgiven. Baptism   is   a sacrament   instituted   and ordered   by   Jesus   Christ. By baptism   we emerge   as   a new   creature, a child   of God   and   receive the   gift   of Holy   Spirit. It   is believed   that   after   baptism   our   old   man   dies   and   is   buried   Ã‚  with Christ. Moreover It   Ã‚  is   Ã‚  hat   before     baptism you   are   a   child   of   the   devil   and   after   baptism   you   are child   of   God. A   man who   believes   in   Jesus, but   do   not   receive   baptism   in   his church   is   not   a   Christian. For   a   Christian   it   is   not   only   important   to   believe   in   God   but   also   to receive   what   God   gives   us. It means   to   give   thanks   to   God   for   everything. Chester Company Essay

A unique and interesting problem arose when one company, a monopoly within the business-to-business (B2B) sensor market, split into six companies with identical products and equal footing within the market. As Director of Finance for Chester Company, one of the newly formed entities, it is important for me to identify a strategy that will enable the company to remain viable and be successful in the future. An in-depth analysis of the industry situation report provided good metrics to project future customer desires and total market potential. In order to be successful, the strategy that the management team develops must work within the identified parameters while attempting to predict how the other five companies in the B2B sensor market will proceed. There are only two segments of the B2B sensor market: low technology and high technology. The only product Chester Company offers currently fulfills the needs of both markets but this will change as the newly formed entities revise and develop products to meet customer needs. The high tech segment is appealing but will require continual investment in research and development to maintain the standards that customers expect. It will be easier to meet the needs of the customers within the low tech segment but there will likely be more competition for market share. 1. The strategy that I would like to see the management of Chester Company adopt over the next five years is that of â€Å"niche cost leader† (Capsim Management Simulations, 2012) for the low technology segment of the B2B sensor market and to obtain thirty-five percent of that market. This will be achieved by appealing to customers’ sense of thrift. To cut prices below the competition, management should retain the current product and not invest much in research and development. Production costs must also be greatly reduced. To do this, an early investment in automation is necessary as it will reduce labor expenses in future years which will increase the margin and profitability of the company. This investment will be financed through the issuance of stock and long term bonds. I also plan to provide the marketing department with a very generous budget in the first couple of years to aggressively target the market and increase the awareness and accessibility of the product early on. Short term borrowing will be necessary to finance operations and provide a cash cushion to prevent the need for an emergency loan. 2. There is a great chance for Chester Company to earn good profits within the low tech segment over the next five years. Although the price of the product must be kept to a minimum this will be offset by decreasing costs which increases the contribution margin. Also, there is greater demand for products in the low technology segment of the B2B sensor market which is expected to increase approximately ten percent each year. However, Chester Company shareholders may realize a loss in the first year due to the high marketing budget and cost of labor because the automation rating is low. Unfortunately, some sacrifices will need to be made early on to realize greater profits in the long term. 3. The product that is most important to the success of Chester Company is Cake; the product currently being produced. During the first year of business, this product will have the ability to appeal to customers across both segments of the B2B sensor market and will ultimately become the favored product of the low tech segment. Management will take advantage of the dual appeal of Cake in the first year by taking a portion of both the low tech and high tech markets in an attempt to retain some profitability. Ultimately, the product will be positioned so that it takes a large portion of the low tech market and will likely not take any portion of the high tech market by the fifth year. The plan that I developed focuses primarily on the success of the company for the next five years as there will be a lot of volatility in the market and further projections are impossible to make at this time. It is difficult to predict how the competitors within the B2B sensor market will be positioned which makes it essential for management to decrease costs as much as possible and increase market share within the low technology segment of the market. My advice to the rest of the management team is to avoid the appeal of developing a new product for either market early on and to avoid the high tech market altogether within the first five years because it will be difficult enough to remain profitable and succeed without squandering business assets on developing a product which will have little chance of being profitable within that timeframe.

The company which will be started for the manufacturing of stone paving will develop a business strategy and mission and the operations mission and objectives will be aligned to them. The distinctive competence is the fact the local manufacturing that will offer customer opportunity to order desired designs instead of choosing from the available designs. While the stone paving is developed the manufacturability and value engineering activities which are concerned with improvement of design and specification at the research, development, design and production stages of product development will be considered. The foreseen benefits of implementing manufacturability and value engineering are cost reduction, reduced complexity of the paving, reduction of environmental impact and additional standardisation amongst others (Heizer and Render, 2011). Literature suggests different techniques that can be used in the design of products throughout the product life cycle, for the stone paving product techniques that will be used are: o robust design – this will allow small variations in the production of the paving to be done without affecting the product. o computer aided design – the computer will be used to develop and document the different types of paving. o value analysis successful products will be reviewed during the production process to ensure improvements. The aspects of design for paving that will be considered include the sizes, types and colours of paving to be manufactured. Further consideration will  be how the product must be manufactured, its quality and market acceptance. The specifications of the product will be meticulous in order to ensure efficient production. Heizer and Render (2011) states that it is vital to define, design and document a product as it determines the equipment, the layout and human resources required. Engineering drawings will be prepared for the stone paving to show dimensions tolerances, materials and finishes of components. Then a bill of material will list the components, their description and the quantity to make one unit of each type of stone paving. The assembly drawings, assembly charts, route sheets and work orders will be used to assist in the actual production of the paving. The laws and industry standards applicable to the product will be adhered and the product will be produced and delivered in an ethical and environmentally sound and sustainable way. 3. Process design According to Schroeder, et al. (2013) there are different types of processes (batch, assembly line, continuous, job shop, and project) each being suitable for a specific product produced. The concrete paving slabs are a low to moderate volume and will be produced in different types, sizes and colours, therefore the batch process will be more suitable. The factory layout will be designed such that it increases the efficiency and reduces the bottlenecks in the process. As different types of paving will be manufactured, e.g. budget manufactured stone, standard manufactured stone, premium manufactured stone and premium natural stone amongst others, the type of order fulfilment which will be appropriate is the make to order so as to reduce the costs of inventory, storage and damage. The suppliers will also be arranged such that the orders for supply like concrete and aggregates are delivered just in time for manufacturing. The process for the manufacturing of paving will be according to the stages detailed below. 3.1 Batching Aggregates will be used for making the various types of paving. The different aggregate types will be stored separately and so that they are well drained at all times. They will be protected from rain so as to stay dry before being mixed with the cement, thus ensuring that the optimum moisture content is not exceeded. The cement will be weighed to an accuracy of 1% except when batched by whole bags. Aggregates will be weighed to an accuracy of 2%. The weight of the aggregate batched will be adjusted in order to make allowance for moisture contained in the aggregates. 3.2 Mixing After batching, the aggregates and binder will be discharged separately or simultaneously, together with pigment if required, into the mixer and thoroughly mixed before any additional water is added. If a mix has high fines contents it may require longer mixing. Based on measurement of the variable moisture content of the aggregates or visual assessment by operators, water must be added to the mixture to bring it to optimum moisture content. Uniformity is important because differences in water content from batch to batch will result in differences in quality. After mixing, the mixture is stored in hoppers ready for dispensing into the moulds. 3.3 Filling of moulds Two basic principles will be applied for the production machines. The first method takes an amount of mixture and progressively compacts it under vibration until a predetermined height has been reached. In the second method, a gauged quantity of mixture is compacted for a set period. Care has to be taken for variations in density which may result if the gauged quantities are not consistent or the mixture is not uniformly distributed within the mould. Previbration is often used to facilitate filling and any gaps in moulds are thereafter topped up with a second filling of mixture. 3.4 Compaction The standard optimum period of vibration is 3 to 12 seconds and the same standard will be applied when compacting. Concrete pavers with a thickness greater than 80 mm will not be manufactured. Frequency and amplitude of vibration will be optimised for the specific materials being used and the number of blocks being moulded per cycle. 3.5 Curing The quality of concrete pavers is improved by water curing. Curing can be effected in one of three ways: moisture retention, steam curing and thermal insulation. The methods that will be used are detailed below: Moisture retention This is the least sophisticated method, is effective for blocks that are less dense and thus tend to lose moisture rapidly. Loss of moisture from newly made blocks is prevented by wrapping them in plastic sheeting. Thermal curing Newly moulded paving blocks are placed in an insulated chamber for a period of 24 hours. Temperature is increased by the heat of hydration of the cement and no additional heat is provided. The method is therefore inexpensive. 3.6 Quality control Control measures will be implemented at various critical points during the process and specific tests will be undertaken so as to ensure that the end product is of high quality. 4. Layout The company will have a layout strategy that will support its differentiation and value for money strategy. The layout strategy is aimed at developing an effective and efficient layout that will meet the organisation’s competitive requirements. According to (Slack, et al., 1998)  the layout design must consider the achievement of the following:- o maximum utilisation of space, equipment and people o improved flow of information, people or material o improved employee morale and safer working conditions o improved customer interaction, and o flexibility to accommodate changes and innovation 4.1 Manufacturing equipment Batching equipment Weight batching will be performed to ensure that a uniform product is obtained and for smaller projects, whole bags of cement will be used if the sizes of batch and mixer are compatible. Mixer Because a semi-dry mixture is used to mould concrete paving blocks, effective mixing will be done with pan and trough mixers. The size of the pan mixer will be related to production so that batches are used up within a reasonable time. Moulding machine Paving blocks must have fullest possible compaction achieved therefore the equipment must be capable of a high degree of compaction and satisfactory output. The development of the organizational structure should follow after the development of the strategy and the Human Resource department in collaboration with other departments should ensure that the right people are employed and retained for the productivity and sustainability of the business. A risk management plan has to be in place and an aggressive marketing strategy will be designed to ensure customers become aware of our products and the value that can be derived from sourcing paving locally. Bottleneck management will be paid attention to by the Operations Manager as this will impact on the efficiency of the system and utilisation of resources. A range of suppliers will be interacted with in the manufacturing and marketing of the product and therefore an integrated approach to supply chain management must be used. Supply chain is determining factor of the product’s product costs, quality, responsiveness and differentiation. A number of supply chain strategies can be used like many or few suppliers, joint ventures, vertical integration, virtual companies amongst others. Quality management In order to offer quality products to the customers thereby improve revenues and reduce costs, the organization will ensure that quality is managed and continuous improvement efforts are implemented. A variety of techniques can be used to ensure quality is managed, this will start with ensuring that suppliers provide products that meet required standard e.g. cement should comply with SABS EN 197-1 . This will be the norm for other products as well in order minimise the risk of a poor end product. The ISO 9000 process certification, inspections and statistical process control will be implemented. The Operators and Quality Assurers will have to be trained on quality standards and methods for checking. The company like other companies will adopt the both the lean and six sigma process improvement approaches as  these have proved to assist most organizations. Quality control Quality control is defined as the stabilisation and maintenance of a process to produce consistent output (Schroeder, et al, 2013, p210). Throughout the processes critical control points will be defined to control and improve the processes. Control measures will be implemented to:- o Monitor changes in materials so that timely changes can be implemented in manufacture. The control measure will be regularly monitoring of changes in grading and moisture content of aggregates, monitoring mix consistence and measuring wet density of blocks. The causes for a change in density will be investigated in order to ensure correction of the root cause. o Routinely monitor the quality of the product for compliance with the specification. The more routine quality and compliance tests will be the checking on dimensions of blocks, testing strength of blocks and carrying out abrasion tests at an appropriate age. 10. Conclusion The company will achieve its business strategy and maximise profits if it has a clear and well defined operations strategy that is aligned to the business strategy. The use of cross-functional teams and supply chain strategy will assist it to gain competitive advantage and continuous improvement. The product design, process design, layout and supply chain should also support the operations of the company and lead to maximisation of profits. Quality must be managed throughout the processes and risks should be mitigated as the environment internally and externally is rapidly changing and technological advancement results in introduction of new products. 11. Questions have been arisen to whether death penalty should be abolished in countries around the world. The pros and cons of death penalty. Therefore, the purpose of this research study is to look at both sides of the arguments of death penalty. It starts off with the description of death penalty and the different types of death penalty. Interesting issues are brought up like the wrongful executions, death penalty being deterrent to crime and the alternatives to death penalty. There are evidence to both sides of the argument in whether the death penalty should be abolished or not. Based on the investigation that is carried out which evaluates the causes, effects and ways to solve the question of death penalty, the many reasons for why death penalty should be abolished is being proven and thus concluding the thesis statement. When the word death penalty is used, it makes yelling and screaming from both sides of extremist. One side may say deterrence, while the other side may say, but you may execute an innocent man. Death penalty is defined as the killing of a person by judicial process as a punishment for an offense. Today, one of the most debated issues in the Criminal Justice System is the issue of capital punishment or the death penalty. There are 8 types of death penalty practiced in an official capacity in the modern world. Lethal injection is the practice of injecting a person with a fatal dose of drugs for the express purpose of causing an immediate death. Gas chamber executions are where the prisoner is strapped to a chair inside a sealed gas chamber. The executioner (standing outside of the chamber) pulls a lever dropping potassium cyanide pellets into a vat of sulfuric acid, flooding the chamber with lethal hydrogen cyanide gas. The electric chair is also another common form of capital punishment. The prisoner is shaved, strapped to a chair, and fitted with electrodes attached to conductive spongesone on the head, one on the legcreating a direct current. The prisoner is then hooded. The executioner pulls a switch, and 2,000 volts race through the prisoners body as the internal body temperature approaches 140 degrees. Executions by firing squad works on strapping the victim to a chair with five sharpshooters ai ming at the victims heart and all five pulling the trigger. There is also death by hanging. The prisoner stands on trapdoor, and a rope descends from a wooden beam overhead. The rope is fastened around the prisoners neck in a Hangmans noose, which tightens when pulled upon. The prisoner is buried either up to his waist (if male) or up to her shoulders (if female) and then pelted with stones by a crowd of volunteers until obviously battered to death. Death by beheading is probably the most humane form of punishment. The victim is restrained, usually forced to kneel, and the executioner removes the head by way of a sword or knife. Lastly, crucifixion is an ancient method of painful execution in which the condemned person is tied or nailed to a large cross (of various shapes) and left to hang until dead. Aim of report. The purpose of this report is to investigate the factors on why death penalty should be abolished and the many reviews on death penalty by the people all around. This study draws on information gathered from various Malaysian and international articles, World Wide Web sites and video documentary. 2.0 Why are some people for the death penalty? There are a number of reasons on why some people are for the death penalty although majority is on the way of abolishing it. Some sees it as a way to better yet end the crime rates around the world. 2.1 Capital punishment holds the criminal accountable for his/her actions. Justice requires punishing the guilty even if only some can be punished and sparing the innocent, even if all are not spared. Morally, justice must always be preferred to equality. Justice cannot ever permit sparing some guilty person, or punishing some innocent ones, for the sake of equality-because others have been spared or punished. In practice, penalties could never be applied if we insisted that they can be inflicted on only a guilty person unless we are able to make sure that they are equally applied to all other guilty persons. Anyone familiar with the law enforcement knows that punishments can be inflicted only on an unavoidable shudder selection of the guilty (Bedau, H., 1977). Irwin Isenberg (1977) said, when you kill a man with premeditation, you do something different than stealing from him. I favor the death penalty as a matter of justice and human dignity even apart from deterrence. The penalty must be appropriate to the seriousness of the crime (p. 135). 2.2 Prevents recidivism. The death penalty protects the public from the most heinous criminals and it also protects us from psychiatrists, judges, parole boards, and celebrities who can too easily be hoodwinked by a practiced con-man determined to win his freedom in order to continue his criminal career. People on death row are unable to get out of prison and are waiting for the day they are put to death. Once they are put to death, there is absolutely no recidivism to worry about. 2.3 Death penalty is a deterrent to crime. If we do not know whether the death penalty will deter others, we will be confronted with two uncertainties. If we have the death penalty and achieve no deterrent effect, than, the life of convicted murderers has been expended in vain (from a deterrent point of view)-here is a net loss. If we have the death sentence, and deter future murderers, we spared the lives of future victims-(the prospective murderers gain, too; they are spared punishment because they were deterred). In this case, the death penalty is a gain, unless the convicted murderer is valued more highly than that of the unknown victim, or victims (Carrington, F., l978). 3. Why do some people oppose the death penalty? Majority of people oppose the death penalty as it brings more disadvantage to advantage. 3.1 The wrongful executions of an innocent person. Unlike all other criminal punishments, the death penalty is uniquely irrevocable. Although some proponents of capital punishment would argue that its merits are worth the occasional execution of innocent people, most would also insist that there is little likelihood of the innocent being executed. In Georgia in 1975, Earl Charles was convicted of murder and sentenced to death. A surviving victim of the crime erroneously identified Charles as the gunman; her testimony was supported by a jail-house informant who claimed he had heard Charles confess . Incontrovertible alibi evidence, showing that Charles was in Florida at the very time of the crime, eventually established his innocence but not until he had spent more than three years under death sentence. His release was owing largely to his mothers unflagging efforts.(35) 3.2 The high cost of the death penalty. It is sometimes suggested that abolishing capital punishment is unfair to the taxpayer, on the assumption that life imprisonment is more expensive than execution. A murder trial normally takes much longer when the death penalty is at issue than when it is not. Litigation costs including the time of judges, prosecutors, public defenders, and court reporters, and the high costs of briefs are mostly borne by the taxpayer. 3.3 The victims families perspectives on the death penalty. Numerous families and loved ones of murder victims support alternatives to the death penalty for many reasons, including: The death penalty process is a traumatizing experience for families, often requiring them to relive the pain and suffering of the death of their loved one for many years. Life without parole provides certain punishment without the endless reopening of wounds. 3.4 Inadequate legal representation. Almost all defendants in capital cases cannot afford their own attorneys. In many cases, the appointed attorneys are overworked, underpaid, or lacking the trial experience required for death penalty cases. There have even been instances in which lawyers appointed to a death case were so inexperienced that they were completely unprepared for the sentencing phase of the trial. Other appointed attorneys have slept through parts of the trial, or arrived at the court under the influence of alcohol. 3.5 Alternatives to the death penalty. In every state that retains the death penalty, jurors have the option of sentencing convicted capital murderers to life in prison without the possibility of parole. The sentence is cheaper to tax-payers and keeps violent offenders off the streets for good. Unlike the death penalty, a sentence of Life without Parole also allows mistakes to be corrected. 3.6 Religious perspectives on death penalty. Most people are living with their own beliefs or religions though there are minorities of people who are free-thinkers. Almost all religions around the world regard executions as immoral. Among them are Christianity, Buddhism, Jewish, Islam and Judaism . 4.0 There are better methods to punish the offenders than death penalty. Death penalty can be too cruel to punish the offenders and no one should take the life of others other than God. Despite this, offenders are not excused from being punished for what they did to others as they still need to be punished but just with other alternatives to the death penalty. 4.1 Life imprisonment without the possibility of parole plus restitution. The most popular alternative to the death penalty is life imprisonment without the possibility of parole plus restitution. This alternative not only costs much less than capital punishment, but also keeps the criminal in jail for the rest of his life so he cannot return back to society. Restitution means that while the prisoner is in jail, he will be put to work with all the money made going to the family of the victim. 4.2 Prison with parole. The average sentence for someone convicted of murder is twenty years. The average time spent in jail for a convicted murderer before being released is around 8.5 years. These numbers mean that most murderers do receive parole and go back into society. John DiIulio writes that even though some paroled murderers remain dangerous, the vast majority of [them] never commit another murder or violent crime. Many have not only gone straight but have continued paying their debt to society by making post-release restitution, manning youth and community outreach centers that work with juvenile felons, and more (Wall Street Journal, Dec. 15, 1997). 4.3 Reformatories. Reformatories are used to reform criminals working with the physical, mental, and moral issues of their inmates instead of just punishing them as we would in jails. They put their offenders to work for society and try to turn their lives around, so they can live a normal life in society. A good use of this method would be for juveniles on death row. This alternative to the death penalty is a more practical solution, rehabilitating criminals instead of just punishing them.
